Passenger in a Car

Mrs K was a passenger in a vehicle being driven by her husband. Whilst stationary at traffic lights the car was hit in the rear.
We sent a detailed letter of claim to the other driver’s insurers, as a result of which they accepted liability for the accident.
Mrs K injured her right shoulder, neck and lower back. She went to hospital and had 2 weeks off work. Unfortunately, her shoulder symptoms continued and she was in constant pain. She worked for Social Services with physically, mentally and disabled young people and her ability to work was affected by her injuries.
Our client had physiotherapy treatment to her shoulder. She was subsequently referred to a Consultant Orthopaedic Surgeon. She had an MRI scan which showed a possible tear to her right shoulder. She required further time off work. She had grave difficulty lifting her children and carrying out day to day activities.
Mrs K underwent an operation to her shoulder and continued to have physiotherapy treatment. Unfortunately this surgery did not work and she had to reduce her hours of work. Further surgical manipulation of her shoulder was required.
Despite more surgery, Mrs K was unable to continue in her role at work and so she had to retrain. Her home life was also severely affected by her injury.
We were able to obtain compensation for her pain, suffering, loss of earnings and retraining following a face to face meeting with the insurers. This meant that the client did not have to go to court. We dealt with her claim on a No Win No Fee basis. We negotiated an award of over £220,000 for our client, together with payment of our costs by the insurers.
