Compensation after a fall in Santa’s grotto
A woman who fell over a plastic icicle at Santa’s grotto has been successful in her compensation claim for an injury to her leg. She had visited the grotto in a London department store with five members of her family. The elderly woman at the time was in the grotto, in which there were eight people in the small space and it was also dimly lit. The elf had asked the woman whether she could move sideways and backwards so that she was out of the range of the camera.
New liability for spillages on highways
We act for a number of clients who suffers from slips, trips and falls on the highway.
A recent high court decision has changed the way in which local authority can be liable for certain items on the highway. Section 41 of the Highways Act has required that the local authorities maintained and repair defects that are in the fabric of the highway itself. However, the section does not require them to remove obstructions on the highway or surface lying materials.
ASDA to pay £10,000 compensation to a man who slips on a grape
Peter Wardle has received £10,000 for injuries he suffered as a result of slipping on a grape in ASDA. It is not known exactly what Mr Wardle’s injuries were.
A spokesperson for ASDA has denied that there is a problem with cleanliness in the store but said that the judge in this case had taken a dim view of ASDA’s cleaning record.
As well as the compensation ASDA were ordered to pay £18,000 in costs.
Anaesthetist knocked out by his own spillage
An anaesthetist was knocked out for a short time when he fell to the floor of an operating theatre after slipping in his own spillage of disinfectant.
